Examples or Scenarios

  • The insured, a mechanical engineer, was hired to design a heating system for a new residential property being built by the plaintiffs, that they hoped would heat their entire home in an energy efficient manner. When the heating system failed to operate as they had intended, the homeowners brought a claim against the supplier of the system, the building contractors, the architect and the insured engineer. Beazley retained defence counsel for the insured, and after a six-day trial the judge found that the insured engineer had met the standard of care by designing the system to the specifications he was given and was not responsible for the plaintiff’s flawed expectations regarding the system they purchased  

 

  • The insured interior design consultants were involved in the renovation of hallways in a condominium building. Due to heavy use, the doors in the building required various repairs. Based on the material of the doors, the insured made a recommendation for restoration and retained a sub-contractor to complete the restoration work on the doors. Unfortunately, once the doors were reinstalled, it became apparent that the restoration had not been successful and that the doors would likely need to be replaced. The condominium corporation brought an action against the insured for damages associated with replacing the doors. We retained defence counsel to defend the insured and to bring a third-party action against the sub-contractor, whose work in restoring the doors was negligent.
